California prevailing wages and Salary Workers

CaliforniaPrevailing Wages
Anonymous Subcontractor

Can I use a salaried employee at a prevailing wage job. This means the employee is not paid by the hour. The employee weekly salary would exceed the 20 hrs he would work at any prevailing wage project I'm not able to find any information on the DIR website

Generally, prevailing wage laws will still be applicable if an employee is salaried. So, if a salaried employee is used on a public works job, it's important to ensure they're paid at least the relevant prevailing wage. And, it'd also be important to include that employee's pay in the certified payroll report for the job. Of course, I'll be the first to admit I'm not an expert on the ins and outs of California's prevailing wage requirements. So, to ensure compliance, it'd be wise to consult a California prevailing wage consultant or a California construction attorney who's intimately familiar with the state's prevailing wage requirements before making any decisions. And, there are services like eBacon or Contractors Prevailing Wage which can help with prevailing wage compliance, too.
