broken contract

im a contractor working on a residential project we were hired directly by the owner and we have not yet completed the entire project just partial. the home owner is planning on selling the home without letting us know and has told us that she is almost ready for the plumbers to come back to finish when in reality she is selling her home. what happens to our contract? we are still owed $9750 since last year in september? is there anything we can do?

If you sent a preliminary 20-day notice at the beginning of the project you have mechanic's lien rights that will relate back to the date that notice was sent, even if the property is sold in the interim. You would also need a written contract if the property is owner occupied - no written contract with the owner, not mechanic's lien rights. If you don't have lien rights and the owner refuses to pay, then you can still file suit to collect the amount owed. It's possible you can file suit now if your contract says you are owed money now. Again, that depends upon the terms of the agreement.
