I am a homeowner who hired a structural engineer to complete a set of plans for a metal building on a residential property as well as plans for a home remodel. The contract was signed in Sept 2021 and I was given a 2 to 2.5week schedule. We are now 4 to 4.5 months out and they have not sent anything for the home remodel. The metal building was to be a square tubing building, teh first set of plans that were finally sent 3 months from signing the contract was an I-Beam structure, and now the engineer is saying he will not finish the project because I am changing my mind to many times. I have detailed emails between the PE who I believe owns the firm and the original salesperson.

You really need to provide more facts. Is the metal building to be designed and constructed on your home property? Is the property at issue your homestead (meaning that you own the property and live there)?

How much have you paid the engineer? What is it that you are wanting from the engineer?

Where is the property located? Where is engineer located?

The legal analysis would start with a review of your contract with the engineer, and then extend to any communications which have occurred.

Retain a construction attorney to evaluate your legal situation and to provide advice.

Can someone recommend a construction attorney? Yes on my property. I own it and live there. Metal Bldg Contract total $2150 paid $900 Home remodel Contract total $4250 paid $1900 He said they will not provide any drawings and will not provide a refund Both are located in San Antonio, TX

If I were you, I would prepare a letter to mail by certified mail to the engineer to set out the facts, and demand a refund of the money paid (or whatever other relief you want). Attach copies of your payments, and point out you have received nothing for your money.

If need be, consider filing suit in small claims court (assuming that your claim is less than $20,000), using your letter as evidence.
