Amending a lien-7836020

Upon submitting a lien filing to Levelset there was an accidental submittal by the research team of an invoice that did not belong to our company. With that said, the lien filing is due on the following Monday and this has been realized on a Friday and this lien with the incorrect invoice has already been mailed to the county clerk. What are our options for amending this lien and still having it filed in GA ( where the property is located) with such a short time span between now and the deadline date? I should say that this would reduce the lien balance not increase it.. Thanks!

Matt, You would be able to file an amendment to the lien to reduce the amount claimed after it has been filed. This situation is specifically provided for in Georgia's lien statute. I hope that helps. Thanks, Bill Kidd CURTIS & KIDD, P.A. bkidd@curtiskidd.com

The lien should be amended after the original is filed. OCGA 44-14-361.1(a.1) allows for the amendment.
