Am I eligible to file a Mechanics Lien?

GeorgiaMechanics Lien
GARY GELATT

I am a Public Adjuster here in Georgia. Homeowner hired me to nego their insurance claim for water dmg to their home. In this case, as a project Construction estimator, do I have Lien rights?

Generally, no - public adjusters are not entitled to mechanics lien rights. Mechanics lien rights are typically only appropriate for those who have provided a permanent, physical improvement to the project property (usually, construction work).

While estimating and negotiating are valuable services, since they don't provide any physical change to the property, a mechanics lien claim would likely not be appropriate. With that being said, other claims or recovery options, like payment demand letters or breach of contract claims, could lead to payment.
