On a private works project, your customer will almost always have discretion to rehire you or rescind your termination should it choose. It is important that the parties be clear on the status of the contract if this occurs. Namely, if your termination under the current contract is being rescinded or if a new contract is being entered into. If you are a subcontractor you should against serve preliminary notice if you are rehired. On public works the issue would be much more complicated due to substitution rules.
