My company completed work for a federal contract we were subbed to. The prime went silent after we sent in our request for payment late last year. I need to first find out if the prime has a surety bond for the project (which is required under the Miller Act), and then make a claim against that. So far, I have run searches through USFCR using a few different pertinent NAICS codes, but none of the returned contracts was the one we were subbed to....Read More

Hi, We are a small construction company mainly dealing with residential sector. Due to an understanding reason we hire subcontractors for variety of works. After last year's analysis we have come to understanding that most, if not all of our delays were caused by the subcontractors. Subcontractors are not always on time to do their work which leads the project to fall behind, increasing extra cost and clients dissatisfaction and therefore loss in profit. I would like to ask if there waiver template we can use which would oblige the subcontractor to be on agreed date and if they are not then they simply liable for the penalty or certain fee occurred due to the delay?...Read More

Getting a large deck rebuilt. $42K total. Contractor wants $9k up front for materials, $17k before starting work, $13k once "decking" (top Trex surface) starts, leaving $4K payable upon completion. I'm a homeowner looking to protect myself (and with zero intention of abusing the contractor financially), but understand that the contractor (not knowing me) is looking for a payment schedule most beneficial to him. I have no problem paying for materials upfront, but feel that I should be paying (primarily) upon COMPLETION of milestones (footings, sonotubes placement/filling/code-official approval, ledger, beam installation, joist installation, etc) rather than BEFORE work is done. And leaving only 10% payable upon completions seems way too low. ..... too easy for him to "walk away" if we have a disagreement over workmanship. Notwithstanding my desire to pay upon completion of milestones, I understand that he is entitled to at least sufficient ongoing payments to cover materials and staff/sub-contractor salaries as work progresses. We did a city job for a general contractor in October, November and December 2021 and never received payment for work that was done. Therefore, we pulled off the job December 2021.Surety and General Contractor denied my claim in January 2022 and in August 2022 for not enough information. When we ask what additional information is needed to suffice our claim we get no response from the Surety. What can we do ?...Read More

I was hired to set up and facilitate an estate sale with the grandson of the property owner overseeing the event. The property owner is currently on hospice and her sons are getting ready to sell her home It was my job to help clear things out of the house and set them up in the garage. Since my boyfriend has been friends with the grandson he said yhat i could also set up stuff yo add to his estate sale as part of my fee for the work I provided. The day before the sale i went over to do the finishing touches snd found out that he threw all of my own belongings in a shed breaking a bunch of things. after i took inventory of my things. broken or not, found quite a few things missing. I then found out that he went ahead with the sale a different day. he just did not want yo pay me for the work. Plus he sold quite a few things of mine and kept the profits. I do have records of what is missing, broken,etc. I am wondering if i can take a lien out on the property for this? Thank you for your time...Read More
