Hello, We are a sub-contractor in the state of Ohio and we have been sending NOC's to our suppliers. However, I was just told as a sub that we should actually be sending Notice of Furnishings to the GC, Property Owner, and possibly the finance company. Can you help clarify the notice I should be sending as a subcontractor? ...Read More
We are a general contractor and we were on a project where the client short paid our final pay application. We never sent a preliminary lien on the project and never submitted an unconditional waiver and release upon final payment. We have not been on this project for 9 months. Can we file a preliminary lien now or are they any options for us to pursue?...Read More
I work for a growing flooring and remodeling company and we are learning a few things about preliminary notices for the first time. Who needs to sign the preliminary notice? The template I have has the signature right under the state required "Notice to Property Owner" so does this mean the property owner needs to sign? And regardless of who needs to sign does this document need to be send via certified post mail or can it be sent via an e sign software that shows proof of receipt?...Read More

I'm a GC on a small addition. The framing sub made some errors based on a failure to properly read the plans r take field measurements. After completing the corrections he then issued a change order which was not approved. After explaining that these were his mistakes to correct and in any event you cannot expect to get paid by issuing CO's after the work is complete, he has now sent a prelim notice despite the fact that he was last on the job nearly 60 days ago. My expectation is that he intends to now issue a notice of intent to lien. What is the best way to deal with this?...Read More
Good morning I am hoping you can answer some questions for us regarding an issue we are having with being paid for a completed roofing project. This our first encounter with this type of situation. We filed a mechanics lien with Humboldt County, it was recorded and returned w/o any indication that it was rejected or not valid, we are unsure what to do next since half the information I am finding states that the Lien would not be valid w/o preliminary notice being filed and delivered to customer/property owner within 20 days of starting a project, we were unaware of this. My husband has been in the roofing business for over 20 years and has never known of any preliminary notice having to be filed for each project. We have also spoken with others who have had contacting projects done through various contractors and have never received a preliminary notice. We do include in the estimate a "Notice to Owner that informs customers of the mechanics lien if n the event that payment is not received and/or being disputed. Is this "Notice to Owner" document enough. And if not what do we do now? Thank you in advance....Read More
I work for a subcontractor in Jacksonville, FL, and part of my job is to send out Notice to Owner letters via Certified Mail with Return Receipt – PS Form 3811, or “green card.”
My question is this; once we have received the signed Return Receipt, how long should we keep them?
Thanks in advance for your time!

I am in the process of filling out a 20-day preliminary notice and was wondering if I am able to include a separate sheet for the area where I describe the labor, services, and equipment/materials? I supplied staging (all furniture items) to a property to be listed for sale. An estimate was provided and a contract based on the estimate. After completing the work and adding furniture pieces that were initially credited on the estimate (I was told the items were on site and they were not) I added items necessary to complete the job. The house sold and now the owner does not want to pay me for the added materials. Do I have any recourse? The project began May 1st and ended June 11th....Read More
