We had our shared fence replaced by a fence company. They did a poor job explaining how they got supplies. After job was done they wanted payment in full. We paid out half the day job was completed. One week later the company called and said neighbor had not paid his half and if not paid that a lien would be placed on our property. Within the hour our neighbor paid. 2 months later we got a notice from the supplier that the fence company failed to pay for supplies and if not paid then a ML would be placed on our property. We have since learned that the fence company has failed to pay on over 5 accounts with same supplier and could be more. A ML has been placed on our property and an intent to sue notice has been sent to fence company with all accounts mentioned. What are my options...Read More

What is the correct process to send a prelim notice when there are multiple owners? A new project has 5 different owners. Do we treat each one individually whereby the GC and the lender will each receive 5 copies each (one for each owner) or attach an addendum to one prelim notice listing all 5 owners ? ...Read More

I need to complete a release of mechanics lien in our office and will have it notarized as customer is requesting this be done ASAP. I am going to have it notarized as well. My questions are: 1) When completing a Release of Mechanic's Lien, what is an Instrument No. and where would I obtain this information on the original lien? 2) If I complete this in office, do I still need to do it via Levelset for recording purposes, or do I mail the original to the courts in L.A.??...Read More

Hi, I am in California. I am a landscape designer and gardener that has not been paid, as well as my worker, after many attempts. I have sent the invoice over email multiple times. He claimed the check was stolen from the mail and he would resend it but has stopped responding to my emails since. I have added a late fee and let him know I would have to proceed with a lien if we were not paid. Do I need to file the lien in the county where the work was done- Sonoma, or where I live- Mendocino? Also I was reading I need to file a preliminary notice. Where I did the work was the clients vacation home, how do I find out their primary residence in order to send the preliminary by certified mail? Do I and my co-worker need to file separate liens since we are both self-employed?...Read More

A Burbank plumbing company stated I needed a new sewer line based on video findings of line. He contracted another company to do the work since lost permitting rights for city work. The sub discovered my line could not be replaced using closed ditch due to concrete over line. Original plumber told him to do just saddle and did not consult with me until this was done. Now they want payment and I never got a new sewer line. Can't use the new saddle for open ditch line. If I had been called I would not have approved the saddle work but put my money towards a new line via open ditch. Am I responsible for subcontractors cost? Can he file a lien on my property?...Read More

If we are billing one owner, for one specific property but multiple jobs, should the prelims and liens be filed separately for each individual job or can they be bulked together? And when bulked together, can the job numbers be referenced as "EDP191-197" or do they have to be individually noted as EDP191, EDP192 etc.. ?...Read More
