My company is the HOA and one of our owners has an outstanding balance of $690 for dues. My boss has requested me to file a Mechanics Lien on the property for the amount of the current balance. Is this the correct process when trying to collect HOA Dues?
HOA dues are collected via a lien, but not a mechanic's lien. The HOA has a lien for all dues owed. Under the conodminium documents and applicable law, the HOA is probably entitled to recover any attorney's fees incurred as well.
