What if the Contractor has no Contract? Only a Notice to Proceed, what legal problem would entail this kind of set-up?

I have a Contractor in my current project. There was no contract provided by the Owner, only Notice To Proceed. Now the pending billings which was submitted last were being re-evaluated by the current Management. Findings were all quantities are not evaluated properly due to incomplete plans and specifications during that time. Is there a legal concern if the quantities and unit rates that were approved before will not be honored today based on the evaluation? Thanks.
