If the contract is with the owner or tenants then you must use a Home Improvment Contract that meets that requirements of Business & Professions Cose sections 7150- 7170.

There are 4 general types of construction contracts: Time and Materials (cost plus), Lump sum (stipulated sum), bid and design build. A variant on these formats is the unit price contract. That might work for a large condo or apartment unit type project. It may depend on the phases anticipated, and sales. See attached discussion for more detail and other variations. These formats are all about the same but differ in terms of payment and rights, duties and obligations of the parties. The optimal contracting format will be chosen based on the needs of the owner. For example, if you are using, or developing your own plans, a Design-build type contract is probably the format you will want to use. Your subcontracts are probably the most important aspect of all these contracts, since that is where the liability is controlled.
