What can I do abut a lien filed to an owner who says it does not apply to them as they have leased?

Texas

We filed a lien against a property for which we have not received any payment for. We received a legal notice from the owner asking for this lien to be release due to the tenant being the one who signed a contract with us to complete work. Additionally, the lien was filed 5 weeks late. Can I create a new lien with the tenants information? Will this lien still be valid?

If you performed construction work for a tenant, your lien rights may be limited to the tenant's leasehold interest.

If the tenant build out was sanctioned by the owner, the owner could have liability as well.

Retain construction attorney to review your legal situation and to provide advice.

Good luck.

No. Too late.

Hire a lawyer to file suit against the tenant to collect your money
