We were a subcontractor working on a project and never received payment for the completion of the project. We have filed a mechanics lien on the property, but have not received anything from anyone or had contact with anyone about the project. We are under the impression the general contractor in no longer in business. What is our next step? Also, our mechanics lien is coming up on 90 days, should we extend this?
You could send a demand letter to the owner and notify them that you intend to file a lawsuit to foreclose your lien if not paid by a fixed date. You could also request that they extend the deadline to file a foreclosure action. That would require a written agreement. If neither of those things work, be sure to file your foreclosure action before your 90-day deadline passes and record a lis pendens.
