We have disputed change orders; can they be included in a lien in the state of FL?

Florida
Anonymous Contractor

We submitted proposed change orders and the owner has not approved them. Are we able to include these amount of the lien or are we only able to lien up to our revised contract amount? We have not submitted an invoice for these proposed change orders because they were not approved. What do we need to do to protect our lien rights?

You may include in the lien unpaid labor, services and materials that has been provided to the job. You can amend your lien to include new items up to 90 days from your last work date, not including trivial work or punch-out.
