We are working as a sub contractor on a commercial project in the state of NJ.

We are operating out of NM and the project was in NJ. We have are in process of filing a mechanics lien, is it worth it to send a letter of intent and a notice of unpaid balance?

For a commercial lien, you are not required to file a notice of intent/unpaid balance. You can move forward with the lien as long as it is filed within 90 days of your last date of work. Whether it is worth it to start with a Notice of Unpaid balance will depend on the time you have left to file the mechanic’s lien, and also the amount of money owed should factor in as well.
