Waiver of Lien

I have a Lien Waiver that releases my rights. However, on the ROL it is marked as an Interim and not a final Waiver. The company that owes us also has not sent us an addition change order on the job and I was wanting to know if once I sign the ROL would it waive all our rights?

This answer depends entirely on what is written in the lien release. It is very possible the lien release, while not a final release, acts to release any liens prior to a set date, including potentially your change order. I have seen this very scenario prevent a subcontractor from receiving payment, which was unfortunate given that they had performed the work as requested by the general contractor. If the change order involves a considerable amount of money, I recommend having an attorney review the release language and act according to that specific advise. Very best, Ben House 281-762-1377
