Threatened with mechanic lein from non contractor.

MissouriConstruction Contract
Anonymous Contractor

Home renovation, no issues with main contractor, however, the person who was helping him, is claiming he has not gotten paid, and has threatened to place a lein on the house. Can he do this? There is no contract with him and us, and there is no contract between him and the contractor. If he can, how can I fight this.

MO protects owner occupiers who pay their general contractors in full from the lien claims of remote subcontractors. Unless the owner occupier signed a "consent to lien" a remote tiered subcontractor has no lien rights against an owner occupier who paid the GC in full. Garry Seltzer (mechliens@prodigy.net)
