Signing When full payment hasn’t been made

Hello Good afternoon, Small business here. Payment finally came through after 95 days after work completion. Due to contract finishing touches are to be made and they are withholding $7,000 but want the lien waiver signed yesterday

No. Never filed a lien waiting for the rest of the payment. Concrete pour back was scheduled but now they said we are terminated and will have to pay for remaining work.

You have waited too long to file a lien. So, you have nothing to lose by giving them the lien waiver unless it says it is "final payment." You can sign a "waiver and release of lien upon progress payment." You should take what they have offered and file a small claims lawsuit it they don't pay the balance.

I wouldn’t sign the lien waiver, unless the GC signs a separate contemporanous document that says, notwithstanding th elien waiver, you are owed the $
