Retainer given to GC

CaliforniaLien Waivers

Hello, I have been made aware to get lien waivers from GC after each invoice paid- I am now near end of job. I am located in California this is for commercial site I’m a tenant. I am about to request those waivers however I also paid upfront 35k retainer to him. That retainer has been untouched and sitting there until end of project as part of final installment. Do I need to get a waiver for that as well? How would that work? Or will it just be part of final unconditional waiver once final installment is paid? Thank you

A signed Unconditional Waiver and Release Upon Final Payment will waive any lien rights that the GC has. However, be sure to have the GC get these same releases from any of his subs and suppliers who provided labor and materials on your project so they don’t lien the property. I’m happy to answer any questions you have about this.
