Past deadline to enforce lien, options?

We did a job for a client who then refused to pay their final bill. Thru Levelset, we sent a Notice of Intent to File a Lien and then filed a Lien. My window to File Lawsuit to Enforce Lien or Cancel Lien expired a month ago. I misunderstood and thought that I had 6 months from filing the lien. Do I have any options at this point? Can I at least send her to collections? How do advise me to proceed. Thank you for your help.

You have a lot of options but there are a bunch of questions that need to be answered first. What is the amount of work. Were you the genderal contractor or sub? Is there a written agreement? These would be a few to start with. I would call an attorney and get a free consultation to get some answers to help you.

You can always sue for breach of contract or under other principles. If this is $7500, consider small claims https://www.courts.state.co.us/Self_Help/smallclaims/. If above that but below $25K, county court https://www.courts.state.co.us/Self_Help/25000orless/.

Yes you can place the account for collections with a licensed and bonded certified agency to collect in Colorado. This can be accepted on a contingency bases so to not throw good money after a bad account. The success of the collection is usually known within 30-45 days. If the debtor is a business, I can assist you with the collection and if it's against a consumer I can refer you to a consumer agency that can help you. If collection is not successful then you should look at your suit options. Best regards getting paid.

The 6 month suit window is to foreclose, you'll likely not do that. So, you can sue them for breach or unj. enrich't. Call the office to discuss.
