Do subs have to send NTO the owners primary residence if doing work on a investment property that is vacant?

Good Morning –

You should send the NTO to the address provided by the owner in the Notice of Commencement. In an abundance of caution you can also send the NTO to the owner at the primary residence if that address differs from the one provided in the NOC but I would not do so in lieu of sending it to the address specified.

The NTO needs to be sent to the address on the notice of commencement. If there is not an address listed there, then you can get the address of the property owner from the building permit application. In addition to that, you should also serve it on the address listed for the owner in the property appraiser's records. That will help ensure delivery. Further, under Section 713.18, Florida Statutes, there are multiple methods to serve a notice to owner, including posting and hand delivery. Any of those are acceptable.
