Notice of non payment to a bonding company

Florida

Hello! We are the subcontractors on a project that's funded by Volusia County here in FL. I am approaching my timeframe to send a notice of intent to lien... and I am wondering if I should send a notice of non payment to the bonding company. What are your thoughts?

Ellie, You will need to get a copy of the bond if it is bonded job. Being funded by the County is not enough, the parcel needs to be owned by the County to have a bond. You need to do both notice of to the Contractor within 45 days of starting work and then intent and also notice of nonpayment. Youmust then give the final notice of nonpayment and this must be copied to the surety. You can make demand on the governmental entity for a copy of the bond. It might also be recorded. Hope this helps. We have not formed an attorney client relationship by this email and you would need to retain us to to form such a relationship.
