non payment on subcontract job with no contract with contractor

Texas

Iam a small contractor that took on a sub job, it was small and the contractor paid down $900.00 on a $1,800. job, we also installed a fence that he never paid anything on price $350.00 we all walked job and the home owner liked it, said "everything is great" called and text contractor he is not paying. He also text me that not to contact him because he has a gun. I have the lien filled out and notarized and I know that I have to send notice to file lien to home owner & contractor I do not know where the contractor lives, I know where he works, I can send to his work. Problem.... Is there a notice form I can get or can I just make a letter myself to send ??

In answer to your first question, yes you can send the notice to the non-paying contractor's work address. In answer to your second question, the contents of the notice letter is very important as there is a list of information required by statute that must be included within it. I strongly suggest you utilize a service or an attorney to draft and send your notice letter. I also strongly suggest that you get the notice letter out as quickly as possible as the time limits for sending notice letters and filing your lien is even shorter than usual because this is residential work.
