your tool said i missed the deadline to file a lein, I did sent a letter of intent in jan they replied in Feb by the time i got letter 90 days was up. I thought I had 90 after they refused to pay. with the virus stuff I cant file. so now what
Michigan’s Construction Lien Act requires that a lien be recorded within 90 days of your last furnishing labor or materials. I'm not aware of any extension of the filing deadline due to COVID-19.
However, if you’ve missed the construction lien filing deadline, it does not mean you’re without a remedy. You still have a claim under your contract. The statute of limitations on a breach of contract claim in Michigan is six years.
Claims for $6,000 or less can be brought in small claims court without a lawyer; claims up to $25,000 can be brought in district court and may require an attorney if you are a corporation or an LLC; claims over $25,000 must be brought in the circuit court.
