Mechanic's Lien Bond

Hello - I'm not sure I understand what a mechanic's lien bond is. I am the owner of the property that the contractor has placed a mechanic's lien. Can I apply for a bond without consent from the contractor? Thanks, Kim

Hello Kim,

Yes, you can secure a mechanics lien release bond to release the mechanics lien from your title (which may help you sell or refinance your property, or otherwise keep your property free from the cloud that is created by the lien recording). There are a few good brokers out there that can help you get such a bond if that is what you are looking for!

You don’t need the contractor’s permission to bond around the mechanic’s lien. You can buy one from a bonding company agent. Once you get the bond, you record it in the county where the property is located, and send the contractor a copy by certified mail, return receipt requested. Your property will be released from the lien, but the bond is substituted in its place, so the contractor would then sue you and the bonding company to try to recover the amount of money he/she claims is owed.
