love in tennessee rented home until garage was built in property. with intent to buy home of 98000.00 and verbal agreement of completed garage of apprx. value between 20k-to 30k to be completed. upon completion we new home owners have 40000.00 as down payment to Supposed General contractor as down payment. scheduled closing not once but 3 times. fourth attempt was the general contractor demanding we see his lawyer to sign a lien or they would not show to closing. Closing problems builder now wants 105000.00 for home and still 30000.00 for garage. home owner stated fine closed for 123500.00 Builders attorney waited 7 days placed lien with registerers office. homeowner was never sent a bill for anything , builder walked off uncompleted garage build. no garage door, no side door, no drywall and electric not hooked up, garage incomplete! With builder not showing 3 seperate times for closing, Homeowner was about to loose his secured financing 120 days and would have to restart process of securing financing again! homeowner thought he could file bk against builder., in hearing builder states he was just getting business started and homeowner failed to pay him. homeowner got suspicious because this builder had been referred to homeowner due to several current builds in at least two counties. suspicion General contractor/ builder and now the Builder is first mortgage / bank ? really! new suspicion and now know to be true it is illegal for a builder to take any monies over 25000.00 without a General Contractors License. Lien is still on home and now the unlicensed builder and attorney is forcing sale of bogus lien. Problem we don't have any more monies to fight lien and all attorneys in two counties are friends and builders attorney broke law forcing us to sign lien while not returning homeowners 40000.00 . any help would be tremendous our home is being auctioned October 16 2020 and we need help! we were bullied buy bad corrupt attorney and bogus unlicensed general contractor who is trying to skirt around Tennessee law. I assuming he lied to his attorney about debit to obtain lien . this has been a nightmare for ten years please help us we are old and disabled being abused by builder. oh a new problem this builder had the hill to try to retain our law office full of attorneys.
