On a public works design build project in California funded with local, state and federal funds, is there a state or federal statute that requires the Prime's architects and subconsultants to submit conditional waiver and releases along with their Payment applications during the design phase? If not, is there a document that indicates it is best practice to require it as a method for the Owner to validate that the subconsultants have been paid timely or within the Prompt Pay period? What is the the best argument to require the designers to submit the Conditional Waivers during the design phase? Or is the phase relevant or not relevant because it is a Design Build contract?
