Even if the property has sold to a third party, you may still be able to record a lien against the property if you have properly completed the prerequisites to file a lien under the mechanics' lien statutes. You must be a licensed contractor and must have timely served a preliminary 20-day notice on the previous owner. Additionally, timing is an important factor. If you have properly satisfied the requirements, you may still have lien rights, provided you have not waived them. You should speak with an experienced construction attorney to determine whether you have lien rights on the property. Even if you do not have lien rights, there are other collection avenues, which you can consider. The attorney you speak with can go over the options with you.
