In the state of LA, would a sub-subcontractor have lien rights? We would be a sub to the sub supplying labor.

We are looking to supply labor for the sub of the GC in Hurricane relief efforts in Laura's aftermath. Wanting to make sure I can lien the projects, but it looks to me that we might not be able too. From the Levelset web site: Who can file a Louisiana Mechanics Lien? In Louisiana, parties entitled to mechanics lien protection include prime contractors, subcontractors, laborers or employees, material suppliers, equipment lessors (if leased to owner, contractor or subcontractor by written lease), architects, engineers, and surveyors. In Louisiana, parties who supply fuel for machinery used in the project are considered material suppliers who are entitled to lien protection. Suppliers to suppliers are not entitled to mechanics lien rights in Louisiana.

It is likely you will qualify as a laborer or employee considering sub-subcontractor is not a term we recognize. It may be helpful to contact a Louisiana construction attorney to verify what your position is considering laborers have lien rights in Louisiana. In Louisiana, suppliers and others must send a preliminary notice within 75 days of the last day of each month of furnishing labor and/or materials. Louisiana's deadline to file a mechanics lien is generally 60 days from substantial completion of the entire work. Keep in mind that in Louisiana claimants must act to enforce their lien within 1 year of their filing. This enforcement deadline may not be extended.
