if my time has expired for mechanics lien, can I sue for breach of contract.

I was dealing with a sick husband and my time expired last year for the mechanics lien. I have all the documentation to prove out that he owes me the money even text messages stating when I am going to get paid. (text messages downloaded in pdf)
