How to see if a bond was filed around my recorded liens in california

California

We have filed our liens. It's now time to foreclose. Before doing so we want to see if GC has bonded around our lien. Our lien shows on the Sacramento Recorders site, but not any Bond. Would it show somewhere else? thanks,Marshall

Be sure to file your lawsuit to foreclose (or have any attorney do so) within 90 days of recording your lien. If the lien has been bonded around you should be served with notice of the bond and the bond would also be recorded. So if there is no bond recorded, you should assume that no release bond has been secured at this time.

The person who bonds around a lien is required to not only record the bond but is also required to mail you a copy of the bond for your records. As a matter of practice, in most cases the person who files the lien release bond will let you know ASAP to avoid keeping the owner involved. So you should know already if a bond was recorded. Unless you have proof that a lien release bond was filed, you should proceed to foreclose your lien by filing your lawsuit. You can always amend the complaint later if you need to if they decide to bond around the lien later. I’m happy to answer any questions you have about this.
