I filed all paperwork and am seeking to foreclose how do I do this

Once a Montana mechanics lien has been filed, it will only be valid for a period of two years. A foreclosure action must be initiated within that time period, or the claim expires and is no longer enforceable. Foreclosing on a mechanics lien claim is the last step in the mechanics lien process. Typically, foreclosing isn't often necessary as the process usually induces payment. However, if you've filed your claim and payment has yet to be received; it may be necessary. A foreclosure (aka enforcement action) is a full lawsuit. Which involves preparing a case, naming the correct parties, and then waiting for the full hearing to be scheduled. You should contact a local attorney to guide you through this process. Before filing your action, there is one more optional step you can take to get paid. You can send a Notice of Intent to Foreclose. This is just a simple letter to the owner stating that if you aren't paid within x amount of days, that you are ready and willing to file a foreclosure action against their property.
