How long does a filed lien last in TX

TexasMechanics Lien

We had a subcontractor file a lien in the state of TX. How long does it run? Is it a set time frame or does it ever expire?

A Texas mechanics lien is only valid for a certain period of time. If not action to enforce the claim is not initiated within that time frame, it will expire and no longer be enforceable. The deadline to enforce depends on the type of project. For residential projects, the deadline to enforce the lien claim is the later date of either:
  • 1 year from the last date the claimant could file their lien claim (which is the 15th day of the 3rd month from last furnishing labor or materials), or
  • 1 year after the completion, termination, or abandonment of the project.
As for commercial projects, the deadline to enforce the claim is the later of either:
  • 2 years from the last date the claimant could file their lien claim (which is the 15th day of the 4th month from last furnishing of labor or materials), or
  • 1 year after the completion, termination, or abandonment of the project.
The Texas mechanics lien deadlines can be a bit confusing, our 2020 Texas Lien Deadline Calendar might provide a little more clarity.
