My client sold the house I worked on for him and has no money to pay me. What is the best way to get info to the new owners so I can get paid? Thanks, D
There are lien deadlines in every state that must be met to enforce a mechanics lien and to ensure its validity to render payment that is owed. However, if the lien deadline was originally met and the mechanics lien claim is filed on time, most states don't care whether the property has been purchased by a third party who didn't contract for the work.
A mechanics lien is a claim against the improved property that involves the owner, but the owner is really just along for the ride. If there is an innocent third party that purchases the property, the party will generally be liable to satisfy the lien claim and will need to seek recovery from either the original owner or potentially, the title insurance company.
