How can I recover my money

My tree fell on my neighbors property during a severe storm. There was minimal damage to a railing on his property. The tree was in good health and was pruned by an arborist 3 months earlier. Initially, I thought that it was my responsibility to pay for the removal of the tree from my neighbors property. I immediately hired someone to cut up and remove the tree from his property which cost me $1,300. Subsequently, I learned from my insurance company that my neighbor and I were responsible for our own properties regardless of whose property the tree was on. My problem is that my neighbor refuses to reimburse me for the cost of removing the tree from his property. Initially, he stated in an email that he would pay me but has not. These events occurred in September 2020. Question: Can I place a mechanics lien on his property or do you have another suggestion? I have filed in small claims court in Rye, NY but I know that he will not show up in court.

It is too late to file a lien. Go to the hearing in Rye. if he does not show up, get a judgment and have the sheriff collect for you. the court help office should be able to assist you in this process. Good luck
