File to enforce Lien

California

The deadline to enforce the Lien is due in 4 days. My question is that if we do nothing does the lien stay on the records or do we have to cancel the lien.

you need to consult with an attorney immediately. If the lien stays on records after the 90 days are up, and you have not filed the lawsuit, then not only is the lien defective you risk getting sued to get the lien removed. Or you can cancel the lien and sue whoever you contracted with for breach of contract. Of course if your a sub on the job that's going to limit you to just going after the GC.

The lien will automatically expire in 4 days if you don’t file.
