Do I need a lawyer, construction or otherwise?

Georgia

I am a homeowner. I was approached by a roofing company representative on April 2, 2023, to look into (inspect) whether I had enough damage to my shingles to file a claim with my insurance company. Unfortunately, I signed a paper that I was told was just to give the roofing company permission to inspect my roof and start a claim, if indeed there was enough damage. I realize now I should have read the paper completely through first. I wasn’t given a copy of the agreement until I asked for it specifically on April 20. They did inspect the roof and we started a claim. Once our insurance company inspected the damage, they authorized repair only, with a total payout (after our deductible) of $108. The rep from the roofing company then wanted to video document the damage to try to get our insurance to cover the entire roof being replaced. (The rep has continued to push for this, seeming to be more interested in getting a full roof replacement approved than what we want.) When I mentioned that we were thinking of contacting another roofing company for comparison, the rep stated that if we went with another company, the agreement I had signed entitled his company to 20% of the insurance payout. According to the signed agreement, it expires 1 year from the date it was signed. We offered him the entire $108 approved as the claim payout in return for a statement that his company waived any further money, should we go with another company to replace our roof. He refused this. We asked to speak with his supervisor and were given what appears to be a dead number. We were told by the rep that his company is so busy right now replacing other roofs that we were better off not doing anything about it, as his company wouldn’t do much to try to collect this, since we don’t want to use his company. I’m concerned that the company will try to come after us for 20% of the value of the roof if we decide to replace it through another company, regardless of any possible insurance payout. At this time everything is still in limbo. We haven’t finalized the claim, nor have we authorized any further work. Do I need to worry about being sued? Should I retain a lawyer to protect myself?

Thank you for reaching out to the Levelset legal community. If you are in need of specific advice for a current legal situation, you may want to consider reaching out to a licensed attorney in your state directly at their office. This forum is public, so it may not be the right place to discuss a sensitive legal issue. Levelset provides a list of attorneys in each state here: https://www.levelset.com/payment-help/experts/experts-by-state/ . From that directory you may find a law firm in your area to call privately.
