We’ve been hired to do a painting job at a couples house. We made it 70% of the way through. They decided that the work didn’t look good but the work was not complete. We offered to go back multiple times but the wife refuses to allow us back. They offered 1000 on a 4300 job. Do I have a case. Also understand this contract was an agreement by text with their general contractor on the home renovations. The homeowners did agree to use us as well.
Depending on when you started and how far out you are from start date you may be able to file a lien. You can get attorney's fees if the lien is properly filed. It sounds like you nonetheless have some claim either as to the GC or homeowner for breach of contract or some equitable claims. There are a number of other issues at play here as well such as if the home owner hired you directly, you need to have a Home Improvement Contract Act compliant contract, otherwise you could be looking at a counterclaim that provides for 3x damages and attorney's fees.
