Dispute an Illinois mechanics lien

Illinois

A contractor has threatened to file a mechanics lien against me in Illinois. The total amount due has been paid in full. How can I dispute a mechanics lien placed on my home?

You ask how to dispute a Mechanics Lien. The answer is vast, but the primary elements are:

(a) Mechanics Liens must be filed within statutory time limits;

(b) Mechanics Liens must be in the amount of unpaid work in place;

(c) Mechanics Liens must be foreclosed within statutory time limits;

(d) Even a valid Mechanics Lien may suffer from inaccuracies; and

(e) Mechanics Liens are sworn documents - false oath is fraud.

Here, you assert that the contractor has been paid in full for the work performed. If so, how could the contractor bring a valid Mechanics Lien? And, if the Mechanics Lien brought rests on false information, that contractor has opened themselves up to charges of fraud, and Court sanctions.

Overall, it sounds as if you should consult a knowledgable Attorney about your options. I hope this information was helpful. Best of luck!

You can send a demand to sue under the Illinois Mechanics Lien Act.
