CLAIM OF LIEN

We have change orders that were requested via email and went ahead and did the work without a written change to the contract. Now we are seeking those written change orders so we can add them to the contract but nothing yet. Unfortunately, we issued lien waivers through the dates the work was done by mistake because technically they didn't owe us money we didn't bill for. Do we have any recourse to file a lien if need be to include the work we did?

You might still have recourse. It will depend on the wording in the lien releases and how the change order order process played out - including the language in the emails. It's a very fact specific analysis. Feel free to call me if you would like to discuss it further. 484-571-1701
