Can we still lien?

We only provide materials to the sub-contactor that installs the elevator controller. We have no records of if or when our materials were delivered or installed on the property. According to the NYC records this job has been delayed and no elevator records exist for this property which indicates it has not been installed or inspected by the city. What are our rights to lien?

You have eight months from when you provided the materials to assert your lien (I'm assuming that since you're talking about an elevator you're not furnishing them for use in a single family home; if that's actually the case, the time frame is four months). It does not matter when the contractor you provided the materials for actually installed them (in fact, you can also lien for specially manufactured materials not even furnished to the job site). So, if you're within those eight months, you can assert the lien.
