Can multiple parties file a group lien on a job they worked on?

FloridaMechanics Lien

I'm one of several laborers, carpenters and workers on the same commercial job not getting paid. The amount is substantial if you add all of us in together, but no one person is owed a ton. We don't all have the time/funds to file separate liens on the job. My question is can we file a group lien with us all listed as claimants and the sum of what we are all owed?

Good question. The law is not well-defined when it comes to a laborer's lien. I've been doing this over 20 years and have only seen a laborer's lien once or twice. There is no other context in which separate lienors may combine their lien claims, so there is no obvious analogy for allowing laborers to do so. It would require the owner, for example, to obtain multiple signatures to obtain a release of the lien. The lien law generally is very protective of owners' ability to get liens released and this would frustrate that purpose. One unreasonable laborer in the group could hold up payment for everyone. There are many problems with this approach. Florida law does provide a remedy for laborers suing for unpaid wages, which includes recovery of attorney's fees. You may want to consult an employment law attorney to learn your rights in that regard.
