Can I sue a contractor for refusing to pay past due amount ?

I am a sub contractor that paid for the labor of an employee on a project where a verbal agreement was made with the general contractor. The general paid for several months of payroll for this employee and then decided to stop paying and still refuses to paid past due invoice. Can I file a lawsuit against this contractor to collect payment?

Can you file a lawsuit for the money that you paid to your employee for work he did for a general contractor? Yes, you should be able to do that, but you would be in a much better legal situation if you had a written contract with the general contractor. Based on recent changes in the law, you should always have a written subcontract for any work you perform with a subcontractor. I suggest you meet with a lawyer experienced in construction matters to advise you on the best way to pursue your claim.
