Can I still file a mechanics lien

CaliforniaMechanics Lien
Anonymous Contractor

I am a painter contractor. I took this Job in Napa Ca. to paint a hotel. it was myself with other painters who the lady who hired us was paying directly to them. We don't have a written contract. only a verbal contract: 400 dollars a day (8 hours shift). I started working in the middle of february I was getting pay weekly, but the last three weeks I was not getting pay. I didn't get pay for the following days: April 20,21,22,23,24,27,28,29. May 4,5,9. the total is 4400 dollars that she owns me. On May 9, I decided that was not going to return to work on that project, since I was not getting pay. the lady Keep avoiding me, she does not return my calls or text. every time I would Ask when I am going to get pay, she would tell me : let me call you back and hung up. the other painters that were working there did get paid. I didn't get pay even thought I was the one who was running the job. The company who was writing the checks is Hefco Development. I would like to know if I can still file a Mechanics lien? or go to small claims court? what are my options now? please help me. if you need any more information, please let me know. thank you

You cannot file a mechanic’s lien claim, but you can go to small claims court. Small claims court is perfect for this situation and would get you the money the fastest.
