I was hired to be the GC to remodel a house to rent out by the home owner. Every on the contract was to be done by june 1st , the contract stated nothing about docking my pay for being late on the deadline .june 1st came and I was not completed and june 10th I had to go on vacation , so i speak to the home owner and tell him im not done and i gotta step away for a week he says well your essentially costing me $40 a day that that place is not rented out I acknowledged that and he says well then im going to have to dock you 40 dollars a day i said ok because we were on the subject of me leaving for a week and thats what I was talking about $40 a day for 7 days $280 i agreed upon . well i just finally got paid on the job and he docked me everyday I was past the 1st of June . but heres my arguement an i think im absolutely right , the contract says nothing about pay being docked after the 1st id not completed and #2 as the project went along we continually added task after task after task 20 to be exact but he did not a 1 days time to the deadline to get this extra stuff done. And alot of the 20 added tasks had to be done before i could do tasks on the contract . so essentially in a nut shell I had 30 days of work to do in 30 days for x amt of dollars halfway in we realize theres another 30 days worth of work needing to be done in order to do the first 30 days worth of work so now I have 60 days worth of work to be done in 30 days and if im late im getting docked daily ! Not fair correct ? Legal ? Can i put a mechanics lien on the house for the rest of my money ?
