Can I file a mechanics lien if I have not preliened the property on a job that the owner requested work.

I'm an electrical contractor that did work on a project that I filed a pre lien for some previous work but then have three invoices for service work out of warranty that the owners representative / realtor requested and we have not been paid. I sent all the invoices 20/21 days ago and have not been paid.

If you have a direct contract with the owner, then you don't need a prelminary notice for the work to preserve your lien rights. If you don't have a direct contract with the owner, your previous prelminary notice may still preserve your lien rights for later work. If you would like to send me the written contracts and invoices, I'd be happy to do a quick review for you to get a clearer picture of your lien rights. Email tjulander@ostergar.com
