Hi, My last date of work was 11/7/20 on this project, I sent a notice of intent in march, can we proceed with filing a lien on this?
You can file a lien for labor and materials used to improve a property which the owner doesn’t pay for. You can’t file a lien for profits lost, on work you would have performed but didn’t, as a result of an early termination. Hope that helps.
Also keep in mind there may be a mortgage on the property. If so your foreclosed lien would be second in priority to the mortgage.
