Can I file a mechanics lien?

Virginia

I'm a subcontractor that finished work on a project and the customer still has a $50k balance. I am unable to get through to them to get payment for the remaining balance.

If you are a properly licensed and authorized subcontractor in Virginia, you have lien rights for up to 90 days after the work was performed; however, except for retainage, the lien cannot include costs that we incurred more than 150 days prior to the date when the last work was performed. Additionally, if you were a subcontractor to the GC, then depending on the language of the subcontract you may be able to pursue a breach of contract action against the GC. You should consult an attorney to understand the full range of options, costs, etc. related to exercising any remedy you may have.
