Can i file a mechanics lien

Ohio

We are a wifi company that installs hardware into hotels that enables hotels to connect to the internet. We also provide for a monthly fee guest support to that property where any guest or employee that has issues connecting to the internet then they call us and we assist with getting them connected, reboot the equipment or assist in any way to make the over all guest experience a better one. We have a hotel that has not paid us in a year. They are stating they wont be paying us. Can i file a mechanics lien or what is the best way to go about getting our money?

I generally try to look at mechanic's liens as arising from an "improvement" to a property. In this case, we are talking about a router or similar device, and I do not believe that would qualify as an improvement, much the same way that someone installing washing machines could not claim those as an "improvement" to the property itself, because they can be easily removed.

In your case, as you have not been paid, your best course of action is a lawsuit for the balance. It may not be worth it to pursue this though, depending on the amount owed. It also may be more worth it in the future if you beef up your contract and include an attorney's fee provision, so that the other side has to repay your attorney fees in the event you sue and win.

What’s the price for the labor and materials you’ve provided (actually installed)?
